These terms of service outline the rules and regulations for the use of Movement Matters — Performance Therapy's Website.

By accessing this website, we assume you accept these terms of service in full. Do not continue to use Movement Matters — Performance Therapy's website if you do not accept all of the terms of service stated on this page.

Article I: Definitions and Scope of Agreement

Within this agreement, "the Company," "Movement Matters," "Movement Matters YYC," I," "Me," "Myself," "Ourselves," "We," "Our," and "Us" refers to Movement Matters — Performance Therapy and its principal practitioner, Marco de Leon. "The Client" refers to any individual engaging in services provided by the Company. "Services" refers to the full suite of clinical and performance offerings, including Registered Massage Therapy (RMT), Myofascial release (MFR), Fascia Stretch Therapy (FST), RAPID NeuroFascial Reset, TPI Golf Screenings, Anatomy in Motion (AiM) Method screenings, Functional Range Conditioning (FRC) and Personal Training.

The Client acknowledges that Movement Matters provides a specialized, results-focused service that is distinct from a relaxation-based "spa" environment. The goals of the Services are the rehabilitation of injury, the optimization of athletic performance, and the long-term management of chronic pain.

Article II: Clinical Obligations and Informed Consent

The Company agrees to provide Services in a professional manner, adhering to the standards of practice set by the relevant regulatory bodies in Alberta. The Client understands that an "Initial Treatment" session—which may last up to 120 minutes—is a prerequisite for all new clinical concerns. This session is dedicated to a comprehensive medical history review, postural assessment, and physical screening.

‍The Client provides "informed consent" to the proposed treatment plan, acknowledging that:

1. Nature of Treatment: Manual therapy techniques such as myofascial release and IASTM may involve deep tissue work and localized pressure.
2. Potential Risks: Side effects may include temporary muscle soreness, bruising, or skin redness.
3. Communication: The Client has a positive duty to inform the practitioner of any pain or discomfort experienced during the session.
4. Consent Revocation: The Client may withdraw consent for any specific technique at any time during the session.

Article III: Financial Policies and Billing

The Company maintains a transparent fee schedule, which is subject to change with 30 days' notice to active clients. All fees are listed in Canadian Dollars (CAD) and include 5% GST.

Initial Treatment (New/Returning but New Concern): $180.00
60-Minute Follow-up Massage: $130.00
90-Minute Follow-up Massage: $170.00
30-Minute Follow-up Massage: $70.00
Personal Training / Consultation: Per Quote

Payment is required at the time of service via the Jane App's secure payment portal or other methods accepted at the RTC facility. The Client authorizes the Company to store a credit card on file for the purpose of processing service fees and administrative charges.

Article IV: Media Release & Social Media Usage

By providing explicit verbal or written consent during a session, you grant Movement Matters — Performance Therapy the right to record, photograph, and film your likeness, movement patterns, and performance for marketing, educational, and promotional purposes.

Platforms: Content may be published on any current or future social media platform, including but not limited to: Instagram, Facebook, TikTok, YouTube, X (Twitter), LinkedIn, Threads, Snapchat, Pinterest, WhatsApp (Status/Channels), Telegram, Reddit, Discord, and Google Business Profiles.
• Rights:
You waive any right to royalties or compensation arising from the use of such media. You retain the right to revoke this consent for future postings at any time by providing written notice; however, the Practice is not responsible for removing content already shared by third parties.

Article V: Cancellation and No-Show Protocols

To ensure the efficient management of the practitioner’s schedule and to provide fair access to all clients, Movement Matters — Performance Therapy enforces a strict 24-hour cancellation policy.

1. Late Cancellation: Cancellations made with less than 24 hours' notice will be charged 100% of the scheduled session fee.
2. No-Shows: Failure to arrive for an appointment without any prior notice will result in a charge for the full amount of the session.
3. WCB/MVA Exceptions: For clients under authorized WCB or MVA claims, specific provincial regulations may govern the payment of missed appointments, but the Company reserves the right to discontinue treatment for repeated no-shows.
4. Practitioner Cancellation: If the practitioner must cancel a session with less than 24 hours' notice, the Client will be rescheduled at the earliest possible convenience without penalty.

Technology, Privacy, and AI Scribing

We utilize advanced technology to ensure clinical accuracy:

• AI Scribe: We use AI-driven scribing tools (integrated with JaneApp) to capture and parse clinical narratives. By attending a session, you consent to the audio recording of the clinical encounter for the sole purpose of generating medical charts.
• Digital Tools: Data from Meloq Easy Angle (goniometry) and Onform is stored securely within our encrypted clinical workflow.
Third-Party Integration: You acknowledge that your data may be processed through JaneApp, Physitrack, and MailChimp in accordance with our Privacy Policy.

The Titleist Performance Institute (TPI) Section

The Titleist Performance Institute (TPI) is the world's leading educational organization dedicated to the study of how the human body functions in relation to the golf swing. Movement Matters — Performance Therapy integrates TPI's research-based protocols to help golfers of all levels optimize their "Body-Swing Connection™".

The Body-Swing Connection Philosophy
The Client acknowledges that the TPI physical screen is a specialized assessment designed to identify physical limitations that may be contributing to swing flaws, injuries, or performance plateaus. The screen consists of 16 specific movement tests (such as pelvic rotation, thoracic rotation, and overhead deep squat) that correlate directly with the "Big 12" most common swing characteristics.

1. Ownership: The TPI logo, the term "Body-Swing Connection™," and all TPI proprietary screening materials are the exclusive intellectual property of ACTPI LLC.
2. Usage Restrictions: The Client may not use the TPI marks or distribute Company-provided TPI screening reports for any commercial purpose.
3. No Direct Endorsement: The use of TPI methodologies does not imply a direct endorsement of the Client's specific golf game by Titleist or the PGA of America.

Disclaimer of Golf Performance Outcomes
While TPI methodologies are used by 18 of the last 20 Major Championship winners, the Company does not guarantee specific improvements in the Client’s golf handicap, clubhead speed, or score. Golf performance is a multi-factorial result of physical conditioning, swing coaching, mental strategy, and equipment fitting. The Company’s role is strictly limited to the physical conditioning and "Body-Swing Connection" component of the performance team.

By engaging in a TPI Screening or Golf-Specific Assessment:

1. Data Capture: You consent to the capture of biomechanical data using FlightScope Mevo Gen 2 and video analysis via Onform.
2. Usage: This data is used solely for the development of your individualized performance program.
3. Client Ownership: You retain rights to your personal performance metrics; however, the Practice retains ownership of the specific clinical interpretations, "Golf Performance Audit" reports, and proprietary protocols developed therefrom.

Digital Content License Agreement

The Company grants you a limited, non-exclusive, non-transferable license to use materials provided during your treatment (e.g., customized exercise programs via PhysiApp, Complete Anatomy visualizations, and digital dictations). For clients purchasing digital exercise programs, mobility protocols, or educational video content from Movement Matters — Performance Therapy, the following license terms apply. These terms protect the proprietary "know-how" and instructional design developed by Marco de Leon.

Grant of License and Permitted Use
The Company grants the Client a limited, non-exclusive, non-transferable, and revocable license to access and use the purchased digital content for personal, non-commercial use in Canada. This license is intended solely for the individual purchaser to support their home exercise or mobility practice.

Prohibited Actions and Restrictions
The Client shall not:

1. Distribute or Share: Upload the content to public websites, social media platforms, or shared drives.
2. Modify or Create Derivatives: Alter the video files, scripts, or instructional PDFs to create new products.
3. Commercial Exploitation: Use the content to train other individuals for a fee or as part of a professional fitness business.
4. Remove Notices: Delete any copyright, trademark, or watermark belonging to Movement Matters — Performance Therapy or its licensors.

Termination of License
The Company reserves the right to terminate the Client’s access to digital content if a breach of these terms is detected. Upon termination, the Client must cease all use of the content and delete any downloaded copies.

Professional-Client Relationship

Accessing this website or communicating with the Practice via email does not establish a Registered Massage Therapist (RMT) or Certified Personal Trainer (CPT) client relationship. A relationship is only established upon the completion of a formal intake and a physical Initial Assessment.

Liability, Risk Allocation, and Indemnification

The high-performance nature of the services provided at Movement Matters — Performance Therapy—often involving heavy resistance, dynamic movement, and intense manual therapy—requires a clear understanding of the inherent risks.

Assumption of Physical Risk
The Client acknowledges and voluntarily assumes the risks associated with the Services, which include, but are not limited to:

1. Manual Therapy Risks: Temporary bruising, soreness, or redness from myofascial release, FST, or RAPID-NFR.
2. Exercise Risks: Muscular strain, ligament sprain, joint injury, or cardiovascular stress resulting from resistance training or FRC.
3. Facility Risks: Slips, trips, or falls within the RTC facility or during the use of gym equipment.

The Client represents that they are in adequate physical condition to participate in the Services and have disclosed all known medical conditions and injuries to the practitioner.

Release of Liability and Indemnity
To the fullest extent permitted by the laws of Alberta, the Client agrees to release and hold harmless Movement Matters — Performance Therapy, Marco de Leon, and the Renegade Training Company from any and all claims, demands, or causes of action arising from the Client’s participation in the Services, including those alleging negligence on the part of the Company.The Client further agrees to indemnify and defend the Company against any third-party claims or legal fees resulting from the Client’s own conduct, breach of this agreement, or misuse of the facility.

Limitation of Liability
The Company's total liability for any claim related to the Services, whether in contract, tort, or otherwise, shall be limited to the total amount of fees paid by the Client to the Company in the twelve (12) months preceding the claim. The Company shall not be liable for any indirect, incidental, or consequential damages, such as loss of professional athletic income or the cost of external medical treatments.

Professional Designations and Credentials

The efficacy of the Movement Matters — Performance Therapy framework is rooted in the extensive and verifiable certifications held by Marco de Leon. These credentials provide the clinical and technical authority required to execute the "Assess, Mobilize, Stabilize" protocol.

RMT (Alberta): Registered Massage Therapist; soft tissue and manual therapy.
CPT (NASM-PES): Performance Enhancement Specialist; strength and conditioning.
FST Level 1/2/3: Fascial Stretch Therapist; joint decompression and fascial mobility.
RAPID-NFR: NeuroFascial Reset; neurological approach to soft tissue pain.
TPI Certified: Titleist Performance Institute; golf biomechanics.
FRCms: Functional Range Conditioning Movement Specialist; joint health and control.
SFMA / FMS 1: Screening for movement dysfunction and injury risk.

The Client understands that these certifications denote a "specialist" focus in sports performance and chronic pain movement, rather than a general practice in traditional healthcare.

Governing Law and Dispute Resolution

Movement Matters — Performance Therapy is a business entity established in Calgary, Alberta. This agreement is governed by the laws of the Province of Alberta and the federal laws of Canada.

Any dispute arising from this agreement or the Services provided shall first be addressed through informal mediation between the Client and the Practitioner. If a resolution cannot be reached, the parties agree that the exclusive jurisdiction for any legal proceeding shall be the courts of the Province of Alberta, located in Calgary.

Entire Agreement and Severability
This document constitutes the entire agreement between Movement Matters — Performance Therapy and the Client, superseding any prior written or oral agreements. If any provision of this agreement is found to be invalid or unenforceable by a court of law, that provision shall be severed, and the remainder of the agreement shall continue in full force and effect.

By accessing the Company’s website, booking an appointment through the Jane App, or purchasing a digital program, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms of Service.
