At Movement Matters — Performance Therapy, your privacy is managed with the same clinical precision as your physical treatment. Marco de Leon acts as the "Custodian" of your health information under Alberta’s Health Information Act (HIA) and the Personal Information Protection Act (PIPA). We are responsible for all personal and health information in our possession, including data processed by our third-party integrated partners.
• Identity & Contact Data: Name, date of birth, email, phone number, address, and health-care number.
• Clinical Health Records: Medical history, injury reports, physical assessment findings, and SOAP notes submitted via JaneApp.
• Biomechanical & Performance Data: Range of motion measurements (Meloq Easy Angle), swing metrics and club data (FlightScope Mevo Gen 2), and movement video (Onform) captured via mobile phone, digital camera and tablet.
• Audio Data: Recorded clinical narratives captured via AI Scribe solely for the purpose of generating accurate session charts. Audio files are encrypted during processing and deleted immediately following the generation of the clinical text.
To provide a results-driven "Body-SwingConnection™" experience, we utilize a dual-platform approach for data management:
JaneApp (Clinical Management)
• Purpose: Securely hosts your primary health file, scheduling, and billing.
• Security: JaneApp is a SOC 2 Type II compliant platform using 128-bit encryption for data in transit and at rest.
• Payment Data: Processed securely via JaneApp; we do not store full credit card details on local servers.
MyTPI Portal (Golf Performance Analytics)
• Purpose: Used for TPI-certified screenings and auto-generating golf-specific training programs.
• Data Transfer: By engaging in a TPI assessment, you authorize the transfer of specific physical metrics (e.g., pelvic rotation, mobility scores) from our clinical software to the Titleist Performance Institute (MyTPI) portal.
• International Storage: MyTPI is operated by ACTPI LLC, based in the United States. Your performance data may be stored on servers located outside of Canada and may be subject to the laws of that jurisdiction.
• Liability: TPI’s privacy standards are independent of this Practice. We act as a"Licensee" of the TPI software to provide these insights.
Additional Processors
• Physitrack (PhysiApp): Delivery of home exercise and rehabilitation protocols.
• MailChimp: Secure communication for practice updates and newsletters (opt-out available at any time).
• Complete Anatomy: Used for visual body education during in-person sessions.
Your information is used solely to identify the root cause of pain, develop individualized programs, and ensure clinical safety. Disclosure only occurs:
• Within your "Circle of Care" (e.g., sharing a report with your Golf Pro or Physician) with your implied or express consent.
• When required by Alberta law (e.g., a court order or public health requirement).
• We do not sell your data.
• Clinical Integrity: In accordance with Alberta regulatory standards for Registered Massage Therapy, we retain clinical records for a minimum of ten (10) years from the date of the last service.
• Safeguards: We employ administrative, technical, and physical safeguards—including encryption, multi-factor authentication, and activity logs—to protect against unauthorized access.
Under Alberta’s PIPA and HIA, you have theright to:
• Request access to your personal and health records (free of charge).
• Request corrections to inaccurate information.
• Withdraw consent for data processing at any time, noting this may limit our ability to provide specific services like TPI reports.
